This site may contain other proprietary notices and copyright information, the terms of which must be observed and followed. Information on this site may contain technical inaccuracies or typographical errors. Information, including product pricing and availability, may be changed or updated without notice. Demon Speed Motorsports, LLC and its subsidiaries reserve the right to refuse service, terminate accounts, and/or cancel orders in its discretion, including, without limitation, if Demon Speed Motorsports, LLC believes that customer conduct violates applicable law or is harmful to the interests of Demon Speed Motorsports, LLC and its subsidiaries.

Shipping & Delivery

Shipping will be via UPS. Stocked items will usually ship within 24 hours of receiving your order. Although we usually maintain inventory on all the items on this site, back orders will automatically be created for items out of stock. You will be notified of ordered items not in stock, and given the option to cancel. For shipments outside the U.S.A., full shipping charges and insurance will be charged in advance, and all customs fees and local taxes will be the responsibility of the customer to pay. All shipments will be insured, and the insurance charges added to the shipping charges. We only charge our actual shipping cost.

International

Customs and import duties may be applied to International orders when the shipment reaches its destination. Such charges are the responsibility of the recipient of your order and vary from country to country. Contact your local customs office for details.

Shipping laws are different in each country. It is your responsibility to check with your Customs office to verify whether the country to which you are shipping permits the shipment of your products. Demon Speed Motorsports, LLC is not responsible for any direct, indirect, punitive, or consequential damages that arise from improper international shipping practices.

Warranties

All products are fully warranted against defects in material or workmanship at the time of receipt. Claims must be made within 30 days from the date of the receipt.

Vehicle racing is inherently a dangerous sport with significant risk of personal injury or even death. When a user participates in vehicle racing, he accepts the risk inherent therein. Demon Speed Motorsports LLC makes no warranty that the use of its products or parts guarantees personal safety or freedom from physical injury or operates as a life saving device.

Demon Speed Motorsports LLC PARTS AND PRODUCTS ARE SOLD “AS IS” WITHOUT ANY EXPRESS OR IMPLIED WARRANTIES WHATSOEVER.

EXPRESS WARRANTIES, IMPLIED WARRANTIES, WARRANTIES OF MERCHANT ABILITY AND WARRANTIES OF FITNESS FOR A PARTICULAR PURPOSE ARE EXCLUDED.

THE ENTIRE RISK OF QUALITY AND PERFORMANCE OF SUCH PRODUCTS AND PARTS IS WITH THE BUYER-USER, SUBSEQUENT USER, OR AGENT THEREOF (COLLECTIVELY REFERRED TO HEREIN AS “USER”).

SHOULD SUCH PRODUCTS OR PARTS PROVE DEFECTIVE FOLLOWING THEIR PURCHASE, THE BUYER AND NOT THE MANUFACTURER(S), DISTRIBUTOR(S), OR RETAILER(S), ASSUME THE ENTIRE COST OF ALL NECESSARY SERVICES OR REPAIR.

Demon Speed Motorsports LLC disclaims all liability for any special, direct, incidental, or consequential damages, or any damages,whatsoever, including, without limitation, the loss of life or limb, or damages due to bodily or personal injury, which may arise or result from the sale, installation, or use of any of it’s products or parts.

The installation of Demon Speed Motorsports LLC products or parts may adversely affect other vehicle components, safety equipment or manufactured goods (collectively “goods”). Demon Speed Motorsports LLC assumes no responsibility for any damage to other goods, or bodily injury that may arise due to failure of other goods, due to installation and/or use, either proper or improper, of its products or parts.

It is the users responsibility to inspect and verify the dimensions, specifications and performance of all products and parts as being appropriate for the use to which the user will put them prior to any actual installation and or use of said products and parts.

Demon Speed Motorsports LLC products and parts are to be inspected by the user before each use for evidence of damage, defect, or wear. Any deviation by the user from the manufacturer’s specifications concerning use, maintenance repair, alterations and modifications constitutes willful negligence.

The liability of Demon Speed Motorsports LLC is limited to the replacement of defective products or parts found under examination by manufacturer to be defective in material or workmanship WITHIN THIRTY (30) DAYS AFTER PURCHASE, and which damage or defect has not been caused by an accident, improper use, alteration, tampering, excessive use, misuse, modification or abuse. The damage of the user shall be deemed liquidated in the costs of replacement of the product or part.

Demon Speed Motorsports LLC assumes no responsibility for errors, omissions, diagrams, pictures, illustrations or text in these instructions or the documents contained herewith. By purchasing or using this product, the user agrees that if any provision of this disclaimer is held to be illegal, invalid or unenforceable under present or future law, such provision shall be fully severed from the disclaimer and this disclaimer shall be construed and enforced as if such illegal, invalid or unenforceable provision never comprised a part hereof, and the remaining provisions hereof shall remain in full force and effect and shall not be affected by the illegal, invalid, or unenforceable provision, there shall be added automatically as part of this disclaimer a provision as similar in its terms to such illegal, invalid or unenforceable provision as may be possible and be legal, valid and enforceable.

Return Policy

All returns must have our prior approval, a Return Authorization Number, and a copy of our invoice or packing list. Returned goods that are normally stock items, and in normal on-hand quantities; and are not being returned due to our error may be subject to a 20% restocking charge. Returned goods must be returned with their shipping charges prepaid, but will be refunded if it’s a result of our error. Goods that have been altered to customer specifications; or are not normally stock items; or not in normal on-hand quantities may be subject to a larger restocking charge, or may not be eligible for return. All return requests must be made within 30 days of receipt of product by the customer.

Miscellaneous

Although the information on this Web site is accessible worldwide, not all products or services discussed in this Web site are available to all persons or in all geographic locations or jurisdictions. Demon Speed Motorsports, LLC and the advertisers each reserve the right to limit the provision of their products or services to any person, geographic area, or jurisdiction they so desire and to limit the quantities of any products or services that they provide. Any offer for any product or service made in the materials on this Web site is void where prohibited.

GOVERNING LAW: In the event of litigation both parties agree that the Law of the State of business registration of Demon Speed Motorsports, LLC shall apply and both parties shall consent to the jurisdiction of said State’s courts, or in the event of diversity of citizenship, the United States District Court for the (District). Both parties expressly waive a trial by jury.

MISCELLANEOUS: The Terms and Conditions constitute the entire agreement between you and Demon Speed Motorsports, LLC with respect to this Web site. The Terms and Conditions supercede all prior or contemporaneous communications and proposals, whether electronic, oral or written between you and Demon Speed Motorsports, LLC with respect to this Web site.
